Client Responsibilities

The client is responsible for providing accurate, complete, and timely information relating to the property, project, site, ownership, existing plans, permissions, restrictions, and any other relevant details.

The client must ensure that they have the legal right to instruct work relating to the property or project.

The client is responsible for checking all documents, plans, drawings, specifications, and information supplied before approving them for submission or use.

N.A. Williams Building Consultancy Limited will not be responsible for delays, additional costs, rejected applications, amendments, or losses caused by inaccurate, incomplete, misleading, or late information supplied by the client or a third party.

Planning Permission And Building Regulations

Where planning permission, building regulations approval, listed building consent, lawful development certificates, or other approvals are required, these remain subject to approval by the relevant local authority, building control body, statutory body, or third-party organisation.

N.A. Williams Building Consultancy Limited can provide guidance and support with applications where agreed, but we cannot guarantee that any application, consent, permission, or approval will be granted.

The client remains responsible for complying with all relevant permissions, approvals, planning conditions, building regulations, legal requirements, covenants, party wall requirements, and any other obligations relating to the property or project.

Third-Party Fees And Services

Some projects may require third-party services or fees. These may include, but are not limited to:

Planning application fees.

Building control fees.

Structural engineering services.

Party wall surveyor services.

Topographical surveys.

Drainage surveys.

Specialist reports.

Energy assessments.

Ecology reports.

Fees And Payment

Fees will be set out in the quotation, invoice, or written agreement provided to the client.

Payment terms will be stated on the relevant invoice or agreed in writing.

Invoices must be paid by the due date shown. We reserve the right to pause or stop work if payment is overdue.

Additional work, amendments, redesigns, extra site visits, further meetings, resubmissions, or changes requested by the client may incur additional charges.

Where a project is delayed, paused, cancelled, or changed by the client, fees may remain payable for work already completed or time already committed.

Deposits And Stage Payments

For some projects, a deposit or stage payment may be required before work begins or before the next stage of work is released.

Deposits, interim payments, and stage payments will be confirmed in the quotation or written agreement where applicable.

Work may not begin, continue, or be released until the required payment has been received.

Cancellations

If the client wishes to cancel an instruction, they must notify N.A. Williams Building Consultancy Limited in writing as soon as possible.

The client will remain responsible for payment for work carried out up to the date of cancellation, including time spent, administration, design work, drawings, meetings, site visits, correspondence, and any third-party costs incurred.

Where work has already started, any deposit or payment already made may be retained in full or in part to cover work completed and costs incurred.

Amendments And Revisions

Reasonable amendments may be included where stated in the quotation or agreed scope of work.

Additional amendments, redesigns, substantial changes, or repeated revisions may be charged separately.

Changes required due to local authority comments, building control requirements, structural engineer input, client preference, site constraints, or third-party requirements may involve additional fees.

Timescales

We will make reasonable efforts to meet agreed or estimated timescales.

However, timescales may be affected by factors outside our control, including client response times, third-party input, planning authority timescales, building control timescales, survey requirements, project complexity, or changes to the agreed scope.

Any timescale provided is an estimate unless expressly confirmed otherwise in writing.

Site Visits And Access

Where site visits are required, the client must ensure safe and suitable access to the property or site.

The client must inform us of any known hazards, access restrictions, unsafe areas, structural concerns, asbestos risks, animals, parking limitations, or other relevant site conditions before a visit.

We reserve the right to refuse or rearrange a site visit if we consider access or conditions to be unsafe or unsuitable.

Accuracy Of Existing Information

Where existing plans, measurements, drawings, title documents, surveys, or other information are supplied by the client or third parties, we may rely on that information when carrying out our services.

We are not responsible for inaccuracies in information supplied by others.

If further surveys, measurements, or investigations are required, these may be charged separately.

Intellectual Property

Unless otherwise agreed in writing, all drawings, designs, plans, documents, specifications, reports, and materials prepared by N.A. Williams Building Consultancy Limited remain our intellectual property.

Once all agreed fees have been paid in full, the client is granted a licence to use the final agreed documents for the specific project and property for which they were prepared.

The client must not copy, modify, reproduce, sell, transfer, or use our documents for another project, property, or purpose without written permission.

We reserve the right to use non-confidential project information, photographs, drawings, or examples of work for marketing, portfolio, or website purposes unless the client requests otherwise in writing.

Use Of Drawings And Documents

Drawings, plans, documents, or information supplied by N.A. Williams Building Consultancy Limited must only be used for the purpose for which they were prepared.

Planning drawings should not be used as construction drawings unless clearly stated.

Building regulation drawings, construction details, and specifications should be checked against site conditions and relevant professional advice before work begins.

The client, contractor, and any appointed professionals are responsible for ensuring that works are carried out safely, correctly, and in accordance with relevant permissions, regulations, and site conditions.

Contractor Responsibility

N.A. Williams Building Consultancy Limited is not responsible for the work, conduct, pricing, workmanship, delays, safety procedures, or contractual obligations of builders, contractors, subcontractors, suppliers, or installers unless expressly agreed in writing.

The client is responsible for appointing suitable contractors and ensuring that appropriate contracts, insurances, permissions, and site arrangements are in place.

Professional Advice

Clients are responsible for ensuring they have appropriate property, project, building works, public liability, and other relevant insurance in place before any works begin.

Contractors and third-party professionals should also hold suitable insurance.
